Although this is a subject most don’t like to talk about, it has never been more important to ensure that everything is in order before you pass away.
It is vitally important to ensure that your Estate and possessions pass to your chosen Beneficiaries and not those who may be seen as undeserving. It is therefore important everyone has a Will in place so that your instructions are set down and your wishes for after death are documented in a legally binding fashion.
We can help you understand the complex jargon often involved in Wills so that you can make an informed decision with regards to your chosen Beneficiaries and just as importantly, who will be your Executors following death. Your Executors will be required to administer your Estate carry out paperwork, and possibly make arrangements with regards to your funeral. It is common to have different Beneficiaries to Executors as understandably death of a loved one can cause much heartache and stress.
We can help you with all your Will drafting needs together with Inheritance Tax issues and also Estate planning. Please contact us regarding any issues you may have in this regard.
Following death your Executors will no doubt require Probate services. Probate is the legal authority to administer an Estate and the process in doing so. An application will need to be made to the District Probate Registry in order to obtain a Grant of Probate. When a Grant has been obtained it ensures that the personal representative or Executors can carry out their duty under your Will.
In the event there is no will in situ a Grant will still normally be required although this will be for Letters Of Administration. Personal representatives will take the place of executors and this will normally be your next of Kin.
